A licence is tied to the premises and person in charge, so allow approval time before opening. Penalties are in the table on the right, as published by each authority.

Business licence application FAQs

Do I have to register to open a tutorial centre?

Providing courses to 20 or more people on any day, or to 8 or more at once, makes it a ‘school’ under the Education Ordinance, which must register with the Education Bureau. Tutorial classes are private schools offering non-formal courses. The exemption order only waives some provisions, such as fees and teachers, not registration. An unregistered school faces a maximum fine of HK$250,000 and 2 years’ imprisonment.

What licence do I need to open an estate agency?

A company needs an estate agent (company) licence: at least one director must hold a valid estate agent’s licence, and a licensed agent must control the business. Each premises needs a business particulars statement. The Authority’s fees: HK$2,800 for 12 months, HK$5,460 for 24 months.

How much does an employment agency licence cost, and how often is it renewed?

The Labour Department licence fee is HK$2,000, valid for 12 months. Each branch copy costs HK$385. Submit new applications at least 1 month before opening, and renewals at least 2 months before expiry.

How do I set up a charitable organisation?

First choose a legal form. Most tax-exempt charities are companies limited by guarantee. After setting up, apply for section 88 confirmation on Form C.D.22. The IRD only confirms tax-exempt status; it does not register charities.

Do I need to form a company before applying?

If applying in a company’s name, form the company first. Estate agent company licence applications need the Business Registration Certificate, Certificate of Incorporation and director list. Employment agency applications through a limited company also need company documents and business registration. SetupHK can handle company formation alongside.

Formation costs and packages

How much commission can a foreign helper agency charge?

Under the Code of Practice for Employment Agencies, commission to job seekers must not exceed 10% of the first month’s wages, and is payable only after those wages are received.

How long does a licence application take?

It varies by department. The Estate Agents Authority usually approves within 10 working days of complete documents. Tutorial centre registration involves several departments and depends on the case. The IRD aims to reply to charity tax exemption applications within 4 months when information is sufficient. Employment agency applications must be filed at least 1 month before opening.
