The IRD goes by marital status during the year of assessment. As long as the marriage is registered at any time within the 2025/26 year (1 April 2025 to 31 March 2026), you can claim the married person's allowance for that year.

Can I claim if I divorced before filing my return?

Yes. The test is whether you were married at any time during the year of assessment, not your status at the time of filing. If you were married at any time during 2025/26, you can still claim for that year even if you divorced before March 2026.

Can I claim if my spouse is not a Hong Kong resident?

Yes. As long as there is a legally valid marriage, the spouse need not be a Hong Kong permanent resident for you to claim. On a first application, or if the information does not match IRD records, you may need to submit a copy of the marriage certificate.

Can both spouses claim the married person's allowance at the same time?

No. Only one spouse in each couple can claim it; it cannot be claimed twice. If both tick the box, the IRD will automatically allocate it to the more favourable spouse and notify the other to amend.

I forgot to claim the married person's allowance. Can I fix it?

Yes. After receiving the notice of assessment you can call the IRD or submit a written request for correction; you can also complete form IR831 to apply for a correction. Requests are accepted as long as they are made within the assessment period.

Summary

The core decision on the married person's allowance comes down to one question: joint or separate assessment? When one spouse's income is clearly lower, joint assessment is usually more cost-effective; when both spouses have high incomes, separate assessment almost always saves tax. We suggest running the numbers with your actual income each year before deciding.

If you need help working out the best way to file, or want us to handle the filing application, find out about SetupHK tax filing services.

Further reading:

Salaries tax calculation and personal allowances: a complete guide

Complete conditions for claiming the dependent parent allowance

Tax filing guide for the self-employed / freelancers

Salaries tax provisional tax calculation

Last updated: May 2026

[1
299,300,301,302
post-5451","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-tax-information","tag-299","tag-300","tag-301","tag-302
["GET
